Terms of Service

When you use VoiceGremlin's products or services, you are agreeing to these Terms of Service ("Terms"). Violation of these terms may, at our discretion, result in us terminating your account.

We may update these Terms at any time. If we make significant changes, we will refresh the date at the top of this page.

Definitions

"Company", "we", "our", or "us" refers to VoiceGremlin LLC.

"Services" refers to our website (voicegremlin.com) and any product created and maintained by VoiceGremlin LLC, whether delivered within a web browser, via API, or another format.

"You" or "your" refers to the people or organizations that own an account with our Services.

Account Terms

• You are responsible for maintaining the security of your account and API keys and for ensuring that any of your users do the same.
• You are responsible for all content posted to and activity that occurs under your account, including tests run by any users, scripts, or CI pipelines using your API key.
• You are responsible for the calls you schedule. You agree only to schedule calls to phone numbers you own or are authorized to use.
• If you use this service to spam, abuse, annoy, or otherwise harm others, you are in violation of these Terms and possibly various laws.

Payment, Refunds, and Plan Changes

• The free tier provides a one-time allotment of test minutes that expires after 14 days.
• Paid plans are billed monthly and confer the indicated allotment of test minutes. When exhausted, your account will be unable to schedule new tests.
• Upgrades take effect immediately. Downgrades take effect at the start of the next billing cycle.
• All fees are exclusive of all taxes, levies, or duties. Where required, we will collect those taxes on behalf of the taxing authority.
• We process refunds according to our Refund Policy.

Cancellation and Termination

• You can cancel from your account dashboard. Contact support@voicegremlin.com for help.
• Cancelling means you won't be billed again. You retain access to schedule tests with remaining minutes and query results for 60 days. After 60 days, all content is permanently deleted.
• If you cancel before the end of your current paid period, your cancellation takes effect immediately. We do not prorate unused time.
• We reserve the right to suspend or terminate your account for any reason. Suspension means you can't access the account or run tests. Termination results in deletion of your account and all data.

Modifications to the Service and Prices

• We reserve the right to modify or discontinue any part of our Services with or without notice.
• When we change pricing, we tend to exempt existing customers. If we do change prices for existing customers, we will give at least 30 days notice via email.

Uptime, Security, and Privacy

• Your use of the Services is at your sole risk. We provide these Services on an "as is" and "as available" basis.
• We may temporarily disable your account if your usage significantly exceeds fair usage limits.
• We take measures to protect your data through backups, redundancies, and encryption.
• You agree that VoiceGremlin may process your data as described in our Privacy Policy.
• We use third-party vendors including Supabase, Telnyx, Stripe, Netlify, and LLM providers.

API Terms

Any use of the API is bound by these Terms plus:

• You are responsible for keeping your API key secret. Tests run with your key are attributed to your account.
• Abuse or excessively frequent requests may result in temporary or permanent suspension of API access.
• The API is the primary interface. The web dashboard is a convenience layer on top of the same API.

Copyright and Content Ownership

• You give us a limited license to use the test goals, transcripts, and results you submit to provide the Services. All materials you submit remain yours.
• The Company owns all intellectual property rights in the Services themselves.
• You agree not to reproduce, copy, sell, or exploit any portion of the Services without express written permission.

Liability

The Company is not liable for damages of any kind resulting from use of the Services, inability to access data, or unauthorized access. In no event shall total liability exceed the amount you paid in the twelve (12) months preceding the claim.
